Section 301 Tariff Litigation
Section 301 Tariff litigation update.... The case filed with the U.S. Court of International Trade in 2020 by thousands of U.S. importers arguing the validity of the Section 301 tariffs on goods subject to List 3 and List 4A might be inching closer to a decision. The oral argument was held on January 8, 2025 in the US Court of Appeals for the Federal Circuit (CAFC). The audio recording is available at

While a formal decision may be several months away, the Customs entry filings involved in the litigation will remain in “unliquidated” status if liquidation suspension was requested by the bond principal. Since unliquidated entries can compromise underwriting upon bond renewal, it is important to inform your surety of the bond principals involved in the litigation.
